Minnesota is the latest state to weigh in on the ethics of metadata. Following the majority, Minnesota’s opinion requires lawyers to take steps to protect against transmission of metadata and disclose it’s receipt. The Minnesota Lawyers Professional Responsibility Board did not take a position on data mining, finding the issue to be “beyond the scope of the opinion.”
