Should You Be Using Grammarly?

Do you rely on Microsoft Word’s grammar check to clean up your writing? You may want to make the switch to Grammarly, the online writing assistant.

Grammarly promises to help you write mistake-free in Gmail, Facebook, Twitter, LinkedIn, and any other app you use including text messages, your browser, and Microsoft Word. The basic version is free, with premium plans starting at $11.66 per month.

Security and Client Confidentiality

Grammarly data is encrypted and stored in the United States on a private, secure network. As to data access and client confidentiality:

Grammarly has a set of policies and technical controls that prevent employees from accessing customer data that is stored or processed by Grammarly systems. Where appropriate, Grammarly uses private keys and restricts network access to particular employees.

While Grammarly may track anonymized, aggregate statistics by website domain, Grammarly doesn’t collect browsing history from specific users while they browse the web. Information such as web server access logs or IP addresses is collected only for a limited time and only to provide specific services to the user, such as fraud prevention.

Apps to Help Law Firms Reopen

In our discussion about COVID-19, we’ve reviewed phase one guidelines and specific steps to take in reopening your firm. One of these is whether to screen employees before returning to work. Sounds reasonable, but how exactly should you go about it? Today we take a look.

Thermal Imaging Cameras, Digital Thermometers, and Self Evaluations

Feever

Feever is an artificial intelligence (AI) based, non-contact thermal imaging technology that detects individuals in a crowd with an elevated temperature. Utilizing a thermal imaging camera and the AI based mobile app, Feevr automatically alerts users when a scanned person’s temperature exceeds a predetermined threshold, allowing for immediate intervention. At a price point of $3250 it isn’t cheap and probably better suited to venues that need to easily screen large groups of patrons. Nevertheless, if this solution sounds appealing, do your research. At least one group has severely criticized Feev’rs accuracy.

Feevr PreCheck

Feevr PreCheck is a more economical “sister” product of Feevr, priced at $299.99. The app lets employees take a temperature reading at home – a far more appealing approach for everyone.

With PreCheck employers would give each worker a digital thermometer connected to a smartphone. Readings would be relayed automatically to the firm through the app. Anyone with an elevated temperature would be instructed to stay home.

Everbridge

Everbridge uses a different approach, based in crisis management communication. Their app allows employers to blast messages out to all employees, one of which includes a COVID-19 self-evaluation. Workers are asked if they have symptoms or if they’ve already had the disease and recovered. They can tap the answers into a smartphone, and the employer can use the results to decide who comes into work and who stays at home. Everbridge calls this “IT alerting,” with licenses costing between $32 and $50 per month.

ProtectWell

ProtectWell is a free app developed by Microsoft and UnitedHealth. Like Everbridge, it uses a COVID-19 self evaluation. Here’s how it works:

Employees are invited to download the ProtectWell app.

Before starting work, employees use the symptom screener to answer a few quick questions.

Employees are instantly notified if they are ready to work, need to stay home and manage symptoms or get tested (where available).

What Should I Do Next?

Using a symptom-checker or self evaluation app is a no-brainer. I can’t imagine why firms wouldn’t use ProtectWell at a minimum. Asking employees to self evaluate for a series of symptoms is more accurate than relying exclusively on the presence of fever.

Using Zoom for Video Conferencing

I love Zoom, but like any tech, there are potential vulnerabilities for new users.

Protect your Zoom account and avoid Zoombombing (aka hacking) by following these suggestions:

  • Be wary of links. Login at Zoom directly rather than using the meeting link. Enter the provided meeting ID to join a meeting.
  • Set screen sharing to host only. Doing so prevents your meeting from being hijacked by a hacker.
  • Use the waiting room feature to prescreen and approve attendees.
  • Try Zoom webinars instead (this is the method I use for all my CLEs). Webinar settings offer advanced controls, including several approaches to prescreening attendees.

Webinars

When I conduct Zoom CLE webinars, I record them. This is a setting I activate as host. It isn’t automatic.

Meetings

Zoom meetings are recorded by default. Zoom help explains this and instructs hosts on how to change settings. This is one area where the USA Today article is misleading. For information on Zoom encryption, see this.

Give Others a Heads Up

No matter what you do, it is common sense to give clients and others a heads up on how your video meeting will be conducted. Advise if you plan to record. Let attendees know if your conference is listen only, whether they can raise their hand, or submit questions.

Documenting Your File

Recordings have their place. For example, preserving the meeting as part of your file. Advanced settings in Zoom allow you to include all participant names, add a time stamp, save chat files, and automatically transcribe audio.

All in all, Zoom is a pretty terrific tool.

Capture Text Messages for Use in Court

A reader recently asked for an app to capture text messages – a very understandable request. Here are some DIY options to consider.

Screenshot Method

Most everyone is familiar with this irritating and incomplete approach, which involves taking partial images of texts that end up overlapping. Screenshots are a pain, often lack date and time stamps, don’t capture contact information or other metadata, and must be combined somehow to form a PDF. Not a great way to go. Next, please.

Decipher TextMessage and Tansee for iOS

The Decipher TextMessage app uses five simple steps to capture text messages for export to PDF. Unlike the screenshot method, it automatically grabs date and time stamps, attachments, and accurate contact information for senders and recipients. It can also recover deleted conversations.

Decipher TextMessage is $29.99 and uses the iTunes interface. If you’re dubious about spending thirty bucks sight unseen, take advantage of the free trial, but this app has a lot going for it. Read more about Decipher TextMessage here.

Tansee iPhone Transfer SMS is another great DIY solution at the same price point for a three-year license. It uses its own proprietary software installed on your desktop rather than iTunes.

The clean printout rendered by (Tansee) allows for a seamless production. (Users can) Bates-stamp each PDF page and produce the thread in one comprehensive file, rather than in disjointed screenshot images pieced together in an unorganized manner. Use of this software allows for a more efficient in-house review process, as well as a more transparent production set to opposing counsel.

A disadvantage of this software is that it does not retain the actual native file, merely an organized photocopy with some of the relevant metadata attached to each message.

Cell Phone Extraction for the Small Firm.

SMS Backup+ for Android

SMS Backup+ is a free app in the Google Play Store that allows users to store texts in a gmail account. Conversations can be printed to PDF using a web browser. Sounds simple enough, but since this is a backup program it can only capture what is presently stored on a phone. There is no mechanism to restore deleted conversations. Another downside: reviewers say the app is buggy. However, as one noted: “I tried other SMS Backup apps, but they are not the same or as good! This app is significantly better (in my opinion).”

Mobile PrintShare, Printhand Mobile, or Mobikin.

Evidentiary Concerns

The evidentiary concerns surrounding use of text messages are substantial. As mentioned, accurate date and time stamps and true identities of senders and recipients are critical. As this post points out, before extracting evidence from smart devices consider employing expert forensic help – not just to get it right, but to secure an independent witness if authenticity isn’t stipulated.
