Oregon Child Support Guidelines Change January 4, 2010

New child support guidelines go into effect in Oregon on January 4, 2010.  Changes include:

  • Contingent cash medical support
  • “Reasonable in cost” defined as 4% of adjusted income
  • New parenting time credit calculation
  • Child care costs caps
  • 10% deviation from the guidelines for consent orders
  • Renumbered and reorganized administrative rules

The Oregon Division of Child Support (DCS) will be posting a new child support calculator and worksheets to help practitioners with implementation of the new rules.  The DCS originally hoped to get these tools up by mid-December, but technical difficulties and staff illness have delayed the process.  They are now hoping to get the new calculator and worksheets posted on the DCS Web site next week.  In the meantime, the final child support guidelines can be found here.

Along with these changes, keep watching the Oregon Judicial Department Web site for a new Uniform Support Declaration, replacing the old Uniform Support Affidavit.  The Declaration is currently before the UTCR Committee which is in the process of soliciting public comment.  If approved by the committee and court, it will likely be effective August 1, 2010, unless adopted out-of-cycle.
